Accidents and Injury

At O’Dwyer LLP we advise our clients on all types of personal injury claims to include accidents at work, road traffic accident, medical negligence claims and product liability claims.  Our experience in this area ensures that each case is dealt in as short a time as possible whilst achieving the best possible results for our clients.

We appreciate that the occurrence of an accident or injury can have a profound and distressing effect on our clients and their families.  We work with our clients on a one-to-one basis to advise and guide throughout the claims process; from dealing with the Injuries Board, the Motor Insurers’ Bureau of Ireland and representing our clients in all courts from the District to the Supreme Court.

* In contentious business a solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement.

Accidents can only be claimed when someone else is at fault.

Two questions have to be asked:

  1. Who is wrong?
  2. What is wrong?

1

A wrongdoer does not have a claim.

2

A claimant must identify a person as a wrongdoer.

3

There is no claim if there is no loss or injury.

4

All injury claims must be handled by the Personal Injury Board (IB).

5

IB only deals with claims where blame is accepted.

6

All claims include a sum of the injury and personal expenses.

7

Claims reimburse and don’t create a profit.

8

All claimants have to sweat to tell the truth.

9

Exaggerated claims are often thrown out.

10

All injury claims must be brought within 2 years of the accident.
